Those who follow this BLOG know I rarely comment on accidents. I usually let them speak for themselves. But this one got my attention. I do not know all the details of this accident but over many years I have been involved in the investigation of several just like it.

For this kind of damage and death to have occurred the boat operator had to have been going way too fast at night. I state that without even knowing the water conditions which may have been perfect, or really bad. Anyone traveling at the rate of speed to result in this was simply going too fast at night.

These markers are called day marks because they are intended for use in the daytime. They are reflective so that boats traveling slowly at a reasonable speed for the conditions can pick them out with a search light but that is not their primary purpose. They are not intended to be lighted navigation aids.

Under maritime law it is the boat operators responsibility to navigate safely and at a prudent speed for the conditions. It is their responsibility to use charts or other means to know where hazards are and to know where aids to navigation are.

To suggest that all Navigation aids should be lighted is tantamount to saying all street signs should be lighted. The are tens of thousands of day marks. It is also absurd to suggest that it could be done cheaply for $39 from Home depot. Lights on Nav Aids must meet rigid specifications for intensity and color and for durability. They have to keep on working for years at a time with minimal maintenance in all weather and in fresh and salt water. No light from Home Depot is going to meet that requirement. Actually, having run a facility for several years that serviced aids to navigation, I was surprised at the $800 price tag. That is significantly cheaper than I would have estimated.

What it amounts to is that the operator of the boat was at fault. He did not know the area and was going too fast for the conditions.

Those who follow these blog know I rarely comment on accidents but this one got my attention:


I certainly do not know all of the details of this accident. But I have been involved in the investigation of very similar accidents, and almost always there is a call by people who are not knowledgeable about marine navigation to have these markers lighted. The truth is, to have hit this pole hard enough to cause damage and death, this person had to operating at far too great a speed at night. The comment about the boat's lights reflecting off the marker is bogus. The reason they are reflective is so a vessel traveling slowly at a reasonable speed can use a searchlight to pick out the markers.


A commenter said they could be lit for $39 with parts purchased at Home Depot. That would last about a day. Markers that are lit have to meet specifications for color and intensity and some flash a specified intervals. They also have to do this for long periods of time, years, not days. In the marine environment materials, especially batteries and electrical circuits deteriorate rapidly and have to be designed and made of materials that resist the marine environment.


Boat operators are responsible for operating their boat at a safe speed for the conditions. They are also repsonsible for navigating safely which means using charts of the area and knowing where markers and hazards are.

This is a very common occurrence in the winter. Make sure you check on your boat regularly and often. Pump out any accumulated water or snow. Remember, thos automatic bilge pumps are designed to handle incidental rain water, not large amounts from snow or leaks.

This does not apply only to moored or docked boats. Boats on trailers or on the hard can fill with water. All that extra weight can cause serious damage. I came home today to find my 12 foot rowboat which is sitting on it's trailer, with a cover over the boat, sitting with the stern on the pavement and the tongue of the trailer pointing to the sky. The weight of the snow on the cover cause the tongue to rotate up. This is minor and did not real harm but it is illustrative of what can happen. But on a larger boat the weight can put a real strain on the hull, casuing cracking and sagging. the water can freeze and expand damaging internal parts. Check your boat, get the snow and water out.

Outage safety tips that may save your life
A little preparation and common sense are key to getting through a storm safely. Here's a handy checklist to print and save.
Generator, heater safety
Tips for using a generator to supply power to your home or business:
• The generator MUST be kept outdoors while running.
• DO NOT refuel the generator while it is running.
• If fuel is accidentally spilled in proximity to the generator, make sure that the fuel spill is cleaned up before restarting the generator.
• Have a fire extinguisher immediately available.
• Do not plug your generator into a household outlet. Power may back feed and injure people working to restore power in your neighborhood.
• Be certain that the exhaust and/or muffler is kept away and pointed away from any combustible material.
• Be careful not to overload the electrical capacity of the generator when connecting to household appliances.
• When using extension cords to connect the generator to household appliances, make sure that exhaust cannot enter the house at the same point extension cords come in.
• Never burn charcoal indoors. Charcoal produces toxic fumes that can kill quickly.
• Get fresh air and help right away if you feel sick or dizzy while using a generator or space heater. Fatigue, nausea or sleepiness are signs of carbon-monoxide poisoning.

This time of year people find many ways to try to keep warm. Keep in mind that most of the ways to keep warm either deplete the oxygen or create Carbon Monoxide. Portable gensets should be outside. Radiant space heaters or heaters that use gas, propane, alcohol or any other fuel deplete the oxygen in the room and create carbon monoxide. The room must be ventilated. As I write this the news programs in Seattle are reporting the carbon Monoxide poisoning in a seafood warehouse
